High court grants bail to top Maoist leader Sushil Roy gets bail

RANCHI: CPI(Maoist) politburo member Sushil Roy was granted bail by Jharkhand high court on Wednesday. The ailing rebel leader, who is in his mid-70s, was granted bail by the court of Justice SC Mishra. Police said though Roy was facing trial in various cases of violence, arson and murder in Jharkhand, West Bengal and Odisha, the state did not oppose his bail plea on humanitarian ground. “There is large number of cases pending against him and he is also the think-tank of the Maoists. The state, however, did not oppose his bail plea due to his poor health condition,” said an IPS officer of the state. There are 18 cases pending against him but he he is very sick and recently underwent a surgery for cancer. “Keeping in mind his poor health we expect that he is not going to survive more than a year.

It would not have been humane to keep an old ailing man like him in prison,” the officer added. Roy was arrested from Midnapore in West Bengal in May 21, 2005 and lodged in Chaibasa jail. in Jharkhand due to security reasons. He was later shifted to Giridih jail. He is presently admitted in the AIIMS in New Delhi for treatment and had even claimed for clemency from government. “Taking cognizance of Roy’s plea, the Rashtrapati Bhavan had even asked for a report from the Union home ministry which, in turn, asked for the records from the Jharkhand government,” said another police officer. Additional public prosecutor Pawan Kumar Choudhary said the court granted bail to Roy after hearing the argument from both the prosecution and defence.

“The court granted him bail because police failed to submit substantial evidence that Roy was also involved in the attack on the house of Baldev and Suraj Sahu at Giridih in March 2003. Another Maoist leader, Babu Mani Singh, had confided before police in August 2011 that Roy was involved in 2011 Giridih attack,” said Choudhary. Baldev and Suraj were killed in the attack and their house was blown up by the Maoists. The advocate, however, said that R Roy would be out of jail only after he gets bail in another case, he added.
